An elected judge recently sought to advise Coca-Cola to remove part of an ordinance that prevents the sale of its products in middle and high schools.
We know that the strategies of global corporations from chatarra and refreshments to prevent any regulation that affects the great control they have established in the homes of the Mexican population are very different and one of them, very repetitive, is covered by amparos and legal actions by the Judiciary that tries to prevent it.
These large corporations, led by Coca-Cola, PepsiCo, Nestlé, Kellogg’s, etc., have introduced hundreds of products against regulations, labels, and now against the regulation of the offering of their products in schools. The most active is Coca-Cola, which has turned our population into the largest consumer of its products in the world, as well as one of the populations with the highest incidence of diabetes, among other diseases caused by the consumption of its drinks.
Much progress has been made in the regulation of the supply of these products throughout the education system, especially in the area of primary education and in the introduction and supervision of secondary and higher education, as regulation is the entire education system.
The scale of the problem obliges us to protect the educational environment at all levels as we face one of the highest incidences of overweight, obesity and diabetes. As many as five thousand Mexican adults suffer from diabetes, one in six adults in our country suffers from diabetes, and it is estimated that one out of every Mexican child will suffer from diabetes throughout their lives.
It is not surprising that corporations seem to be against these regulations, what is surprising is that the judges of the law, the judges who have recently taken their load through popular vote, who are supposed to be the expression of what they want to protect the public interest, the common good.
Let’s go to the Magistrado case:
In the Fifth Tribunal of the Colegiado de Mexicali, Baja California, Magistrate Miguel Ávalos Cornejo tried to give a glass of Coca-Cola to one of his embotelladoras to continue selling his product in high schools and colleges, he said, to relieve her of the burden of the regulation that brought her to the country many years ago, only because of the pressures of this company and others that are in conflict. Magistrate Ávalos Cornejo argued that he was prioritizing Coca-Cola’s commercial interests over the threat to the health and nutrition of the population.
The ballot was cast on February 12, 2026, and fortunately Judges Lorenia Molina Zavala and Priscilla Velásquez Plascencia brought it to trial and brought the case to the Supreme Court; we’ll see what happens there.
The project of sentencing Judge Miguel Ávalos Cornejo, who was elected in the last elections of the judiciary, was, as we explain, to allow the company to continue selling its products at medium and higher levels.
The argumentation in the project was based on the supposed violation of the company’s freedom of work, which completely declared the protection of the population’s health and nutrition. The magistrate could be a good candidate for Donald Trump in the United States to defend his affiliated corporations to establish freedom of labor for the first time in health care.
What Coca-Cola expects through this medium is to cause grI retreated over the back to the health and nutrition of the population. The Magistrate did not consider any type of argument regarding the issue of nutrition or health of the people.
Mexico is expected to consume around 163 liters of food per person per year, one of the highest consumptions in the world. Scientific studies show that the consumption of these products is the cause of 40 million deaths in Mexico. Currently, one in three new cases of diabetes is linked to sugar-sweetened beverages, and one in every three is linked to cardiovascular disease.
Data from a study conducted in 184 countries estimated that consumption of sugar-sweetened beverages in Mexico causes 230 million new cases of diabetes and cardiovascular disease each year. For this reason, from 2024, it was decided to adopt a regulation that would not allow the possibility of comfortable chatting in all schools of the National Education System. Before that, the industries brought forward measures against regulation that sought to preserve their economic privileges at the expense of the health of an educated population.
There is no health system that can prevent harm from consuming these products. As we mentioned, these companies have huge profits here; Most of these drugs sold in the country go to their activists, and that our dejanos are damaged only in health, not only sick, even tens of thousands of deaths are one of the main causes of diabetes and cardiovascular diseases, which are the main cause of illness and death in Mexico every day.
