Nova accepts court decision and will repeat election for rector after illegal exclusion of candidate

A new election for the rectory will be held at Universidade Nova de Lisboa. The university released a statement this Monday, March 16, in which he states that he will not appeal the court’s decision that determined the holding of a new claim.

“The Rector of the NOVA University of Lisbon respects the court decision, which the University will not appeal. The necessary procedures for holding new elections, in strict compliance with what was determined by the Court“, says a note published on the institution’s website.

At issue is a lawsuit filed by the assistant professor Pedro Maló, who had been excluded from the electoral race. At the time, the allegation was that the professor was not a full professor, what led to the temporary suspension of the electionwhich however occurred in September. The elected rector was professor Paulo Pereira.

According to the ruling, to which DN had access, the Legal Regime of Higher Education Institutions (RJIES) does not impose as a rule the need for a title to compete. “The aforementioned precept does not define the category of professor or researcher, which means that, under the terms of the law, professors and researchers of any category can be elected, as long as they perform such functions in a university education or research institution”, writes the judge.

At the same time, other documents, such as the internal regulations, also do not have such restrictions. “Teachers or coordinating researchers from Universidade Nova de Lisboa or other institutions, national or foreign, may apply for the position of Rector. university teaching or research staff who have relevant management experience“, appears in the university document.

The judge considered that Maló’s exclusion was “illegal”. As the electoral process has already been completed, “iIt is important to repeat the electoral procedure from the stage in which the illegal act was carried outwhich includes admitting the Author to the electoral procedure and repeating the other acts indicated in the electoral calendar, after the admission of the candidacies”. NOVA was also ordered to pay the costs of the process.

The university adds that more details about the repeat of the electoral process will be released soon. “In the coming days, additional information will be provided to the academic community by the General Council, in particular on the calendar and procedures related to the new electoral process.”
