Earlier this week, Labor Party (PT) federal representative Rosalía León Rosas presented an initiative in Congress to reform the primary constitutional article on human rights.

In this proposal, the legislator tries to explicitly state in the second paragraph of the cited legal regulation that the Mexican Constitution is the highest norm in the state and that although international treaties can be used as instruments, they are only intended to supplement, but not encmina or al level de nuestra Ley Suprema.

Why is this reform? Since the 2011 reform, Article 1 of the Constitution states that all authorities in the country are obliged to respect human rights recognized by the Constitution and international treaties based on the principle per personit is decided to always apply the law most favorable to the person.

Here comes a fierce debate about this possible constitutional change. For the federal government, this initiative seeks to protect national sovereignty and the will of the people; For others, it could mean a retreat and be used as a pretext to curtail the human rights you have earned because it would violate the principle of progress, which is that a human right you have earned cannot be subsequently removed or curtailed.

Can we consolidate constitutional supremacy without weakening universal fundamental rights? The question is not trivial, therefore it must be analyzed and discussed with due objectivity and calmness, with the right head to evaluate the positive and negative points with the intention of finding a middle ground.

Because the first constitutional article is the heart of the human rights system in Mexico. Changing this number doesn’t just mean putting pen to paper and changing the text, it means changing the form in which games, games and national authorities interpret our words, which will have an impact on the daily life of society.
